Terms of Service — Freedom Factory

These Terms of Service ("Terms") govern your use of Freedom Factory (the "Service"), provided by Freedom Factory Team, LLC ("we," "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 16 years old and able to enter a binding contract. You are responsible for keeping your credentials secure and for all activity under your account.

2. Subscriptions & Billing

Plans: Solo ($29/mo), Team ($79/mo), Agency ($199/mo). Prices are in USD and exclude applicable taxes.
Renewal: Subscriptions renew automatically each billing period until you cancel.
Cancellation: You can cancel anytime in Settings. Cancellation takes effect at the end of the current period; we do not pro-rate.
Refunds: Fees are non-refundable except where required by law.
Quotas: AI-generated images are capped per plan (Solo 20, Team 100, Agency 500 per month). Quotas reset on the billing date.

3. Acceptable Use

You agree NOT to use the Service to:

Generate or publish content that is illegal, hateful, harassing, deceptive, or that infringes others' rights.
Impersonate others or misrepresent your affiliation.
Spam, scrape, or reverse-engineer the Service.
Circumvent quotas, rate limits, or platform policies (including Meta's Community Standards and Advertising Policies).
Upload malware or attempt to compromise the Service or its users.

We may suspend or terminate accounts that violate this section.

4. Your Content

You retain ownership of the brand briefs, prompts, images, and posts you create. You grant us a limited license to host, process, and display your content solely to operate the Service and to publish to platforms you connect at your direction.

5. AI-Generated Output

AI output may be inaccurate, biased, or similar to output produced for other users. You are responsible for reviewing all output before publishing. We make no warranty that output is accurate, original, or fit for any particular purpose. You are responsible for compliance with applicable advertising laws and platform policies.

6. Connected Platforms

When you connect a third-party platform (e.g., a Facebook Page), you authorize us to act on your behalf to publish the content you schedule. You remain bound by that platform's terms. We are not responsible for actions taken by third-party platforms (rate limits, takedowns, account restrictions).

7. Intellectual Property

The Service, including its software, design, and trademarks, is owned by Freedom Factory Team, LLC and licensed to you on a limited, non-exclusive, non-transferable basis for the duration of your subscription.

8. Termination

You may delete your account anytime. We may suspend or terminate your access for breach of these Terms, non-payment, or risk to the Service. Upon termination, your right to use the Service ends; sections that by nature should survive (IP, disclaimers, limitations of liability, governing law) survive.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FREEDOM FACTORY TEAM, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Freedom Factory Team, LLC from claims arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and the parties consent to that jurisdiction.

13. Changes to These Terms

We may update these Terms. Material changes will be communicated by email or in-app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
